In Australia vaping is seen as both acceptable and unacceptable depending on which areas of the country you happen to be. Each state has their own laws on vaping. In both Western Australia and Queensland vaping is forbidden. Though, other states have less strict laws, leaving one unsure as to what the norm is.
Below is a list of places to avoid in Australia if you are a vaper.
- Western Australia: It is legal to vape both nicotine and non-nicotine eliquids here, but there are strict rules on how vaporizers are classified. This makes it very difficult to gain access to vape gear in the first place. Overall, Western Australia is very vaper unfriendly, but the state is in agreement which makes it possible to import devices from other states.
- Queensland: Watch out for this area if you are a vaper. Queensland has banned the import of nicotine and promotional vape goods. In fact, any juice containing nicotine is an offense. Using even e-liquids containing no nicotine is still unwelcome unless in a designated smoking area. This means no vaping on the street, nicotine or non.
- Public Parks: Since Australia’s laws on vaping are unclear, it’s best not to vape in public parks. Many of these places already have smoking bans in place. As it is, each state is trying to come to terms whether vaping falls under these bands.
- Businesses: In the more vaper friendly areas in Australia you will find businesses that allow vaping. However, many states have left it up to each business owner to determine if they will allow vaping or not. So be aware. You may be asked to leave.
- Public Transit: This is another tricky area for vapers, especially because of how crowded these areas can be. You will also no doubt be around children and vaping around them is frowned upon here. No doubt our cloud-chucking machines will easily overwhelm other passengers in public transportation vehicles. Not only that, but the odor from the vapor may not be pleasing to some.
- Canberra: The Australian Capital Territory has a strong stance on vaping. In fact, the vaping laws here are strictly enforced. Avoid any serious issues here by simply not vaping due to the local laws.
- Northern Territory: On a positive note, the northern parts of Australia are okay with vaping, as long as you have a permit for your nicotine. Vaping can seem the norm for many vapers here, just don’t get stopped without a permit. Vaping has not been classified here as being a tobacco product, yet it’s clear they are trying to keep nicotine out of their state. The penalty for not having a permit is a hefty fine.
- New South Wales: People here are still trying to sort out the laws regarding vaping. In this territory they haven’t been working against vape devices specifically. There have been no steps to classify vaporizers under the tobacco control act or as therapeutic devices. The biggest risk here is nicotine, which is still classified as a poison nationally. It’s unclear when and how these rules are being applied. This may cause some anxiety as to where vaping is allowed, or what the consequences are if you are confronted.
Best Practices: Since laws vary drastically from state-to-state it’s difficult to say exactly where you can or can’t vape. The best thing to do is talk to other vapers in the area and find out the laws near you, and speak to people in local areas where you plan to travel.
I smoked 3 packs a day and was on a oxygen for over a year vaping is the only thing that has helped me stay off of cigarettes , been vaping 7 years now and I’m not on no oxygen at all and my dr even approved it for me! Vaping has saved my life for sure!! If vaping gets banned people will just go back to cigarettes and end up costing the government more money for disability!!
